Welcome to Trackey! These Terms of Service ("Terms") govern your use of our platform, operated by Codedge LLC ("we," "us," or "our"). By accessing or using Trackey ("Service"), you agree to comply with these Terms. If you do not agree, you may not use the Service.

1. Description of the Service

Trackey is a software-as-a-service (SaaS) platform that provides music enthusiasts with curated music recommendations and information. The Service is accessible via our website and any associated applications.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into this agreement.

3. Account Registration

  • Accuracy of Information: You agree to provide accurate and complete information during registration and to keep your account information up-to-date.

  • Cancellations: You may cancel your subscription at any time through your account settings. Cancellation will apply at the end of the current billing cycle.

5. Acceptable Use

  • Reverse engineer, decompile, or attempt to access the Service’s source code.
  • Share your account with unauthorized users or access another user's account without permission.

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Intellectual Property

  • Ownership: All content, trademarks, logos, and intellectual property directly associated with the Trackey Service, including the Trackey logo and brand assets, are owned by Codedge LLC or its licensors. Content such as artist tracks, images of album art, or any other materials sourced from Bandcamp, SoundCloud, or other third-party sources remain the sole property of their respective owners. We do not claim ownership of such third-party content, and all rights to such content are retained by their rightful owners.
  • License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal or business purposes, in accordance with these Terms.
  • Restrictions: You may not copy, modify, distribute, or create derivative works based on the Service or its content without our prior written consent.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

8. Termination

  • Termination by You: You may terminate your account at any time by contacting us or through your account settings.

12. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles.
  • Dispute Resolution: Any disputes arising out of these Terms or the use of the Service will be resolved exclusively in the state or federal courts located in Dallas, Texas.
